The ex-lawyer for the former president has resigned as New Jersey's top federal prosecutor. This follows a legal ruling that invalidated her legal standing to occupy the role.
Attorney General's Statement
The nation's top law enforcement official, the Attorney General, announced the prosecutor's departure on the start of the week. She commented that the appeals court finding made it "untenable" for Habba to lead the department effectively.
"Let no one confuse compliance for surrender," Habba stated. "The effort will now reach across the country."
Court Ruling
Her resignation follows closely on a US appeals court ruled that she had been acting without proper authority as the federal prosecutor. This judgment is could influence numerous prosecutions in the Garden State.
The court declared that a temporary posting that did not receive Senate approval ran afoul of the statute on vacant positions.
Ongoing Legal Battle
It was also stated that Habba will stay on at the justice department as a high-level advisor. They intend to challenge the decision of the disqualification, with hopes of a reversal.
Writing online, the Attorney General wrote that judges "must not second-guess the appointment of prosecutors tasked with executing the fundamental role of the presidency of criminal prosecution."

Connection to Donald Trump
Habba, first joined the former president's legal defense in 2021. She went on to acted for her client in his hush-money trial in 2024, leading to his guilty verdict on dozens of charges of financial record manipulation.
Prior to Habba took on the role of US Attorney, the former president had stated he was naming her as his presidential counsellor in a potential future term, calling her as deeply loyal and a dedicated fighter for justice.
